Agreement to Terms

Welcome to MindFu! These Terms of Service ("Terms") govern your access to and use of the MindFu mobile application ("App," "Service," or "MindFu"), operated by MindFu ("we," "our," or "us").

By downloading, installing, or using MindFu, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

Eligibility

You must meet the following requirements to use MindFu:

• Be at least 13 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the Service under applicable laws

If you are under 18, you represent that you have your parent or guardian's permission to use the App, and they have agreed to these Terms on your behalf.

License and Access

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device you own or control for your personal, non-commercial use.

Restrictions

You agree NOT to:

• Copy, modify, or create derivative works based on the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright or trademark notices
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the App
• Interfere with or disrupt the App's functionality

User Accounts

If you create an account with MindFu, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate your account if any information provided is inaccurate, outdated, or incomplete.

Subscription and Payments

Free Features

MindFu offers certain features free of charge. We reserve the right to modify or discontinue free features at any time.

Premium Features

Access to certain premium features may require a paid subscription. By purchasing a subscription:

• You authorize us to charge your payment method on a recurring basis
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are subject to change with notice
• You are responsible for all applicable taxes

Refunds and Cancellations

Refund policies are governed by the app store through which you made your purchase:

• Apple App Store: Subject to Apple's refund policies
• Google Play Store: Subject to Google's refund policies

You may cancel your subscription at any time through your app store account settings. Cancellations take effect at the end of the current billing period.

User Content and Data

Any data you create, store, or transmit through the App ("User Content") remains yours. By using the App, you grant us a limited license to use, store, and process your User Content solely to provide and improve the Service.

You are responsible for maintaining backups of your User Content. We are not liable for any loss or corruption of User Content.

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by MindFu and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The MindFu name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MindFu. You may not use such marks without our prior written permission.

Prohibited Activities

You may not access or use the App for any purpose other than that for which we make it available. Prohibited activities include, but are not limited to:

• Violating any applicable laws or regulations
• Infringing upon the rights of others
• Transmitting any harmful code, viruses, or malware
• Attempting to bypass security measures
• Engaging in any automated use of the system
• Harassing, abusing, or harming other users
• Using the App to provide services to third parties
• Collecting user information without consent

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or availability of the App
• Warranties that the App will be uninterrupted, secure, or error-free
• Warranties regarding results obtained from use of the App

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MINDFU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless MindFu and its officers, directors, employees, contractors, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any User Content you provide

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, effective immediately. This includes the right to terminate for violations of these Terms or for any other conduct we deem harmful to the App, our business, or other users.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the App after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

Severability and Waiver

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us in the App, constitute the entire agreement between you and MindFu concerning your use of the App and supersede all prior agreements and understandings.
